MLS Discount Fee Agreement
Help Sell Real Estate can save you thousands of Dollars when you list your property on our local MLS "Multiple Listing Agreement." By listing your property with us, you will be inviting thousand of your local real estate agents/brokers to show your property, and if you receive an offer from any real estate agent/broker, you should pay him/ her 2-3% commission at close of escrow. This commission is determined by Owner prior listing his/ her property on MLS.
Listing your property with Help Sell Real Estate will save you, the commission you pay to the listing agent/broker. This commission can reach to $10,000.00 or more depending, the price your property is sold. You may receive some phone calls from private parties to view your property. If you receive an offer from any of these parties, you may pay no commission to any real estate brokerage. Paying no commission to a real estate brokerage, means multiplying your savings, and buying a better property.
Help Sell Real Estate agrees to list your home on MLS "Multiple Listing Service" under the following terms:
- Help Sell Real Estate will list your home on local MLS, and subsequently will appear on Realtor.com. It is agreed by most real estate agents/ brokers, MLS is the best source selling your property.
>- Your property will be on MLS and on Realtor.com for a period of six months. If your property is not sold during the first six months, Help Sell Real Estate will extend your listing for an additional 3 months only.
- The Broker's MLS Fee is $399 Dollars paid in advance to Help Sell Real Estate. Said listing fee is deemed fully earned upon submitting Owner's property on MLS.
- It is expressly understood that this is an Open Listing Agreement, and as such, the Owner reserves the right to sell the property to any buyer who the Owner finds and procures on his/ her own, without obligation for a commission to Broker or any Brokerage.
- Broker is a realtor/member of MLS, and as such must abide by MLS rules and regulations. Owner agrees to assist Broker as necessary to comply with all MLS rules and regulations, including disclosing the ultimate sales price, Buyers' name and terms of the sale of the property. Owner agrees to notify Broker in writing immediately upon entering into any real estate contract for the sale of the property and that includes the name of the Real Estate Agency, as well as the Agent's name and a complete copy of the purchase agreement. In addition, Owner hereby authorizes the title company handling the closing of the property to provide all such information directly to Broker. Owner hereby indemnifies Broker for all cost, expenses, attorney fees and loss to Broker in the event that Owner fails to timely comply with the aformentioned obligations.
- Broker may terminate this Agreement upon (24) hours written notice to Owner, and in such event, Broker should refund MLS Flat Fee $399.00 in full to Owner. If Owner wishes to terminate this listing Agreement, in such event, Broker will not refund MLS Flat Fee $399.00 to the Owner.
- Broker shall not inspect the property nor make any representations as to its condition or marketability. Broker shall reply on information furnished by Owner when offering the property through the MLS. Owner represents and warrants that all information provided on the MLS Data Application sheet provided to Broker is true and correct to the best of Owner's knowledge and belief. Owner shall protect and hold harmless Broker, or any other Broker, from damages, costs, attorney fees or any expenses whatsoever related to the acts of third parties or loss or damage to the property.
- Owner understands and agrees that Broker is merely entering the information of property on MLS. Owner understands and agrees that Broker will not provide a real estate sign, lock box, property disclosures and/or any advertising services during or after the property is listed on MLS. Owner understands and agrees that Broker is not representing the Owner in this Agreement.
- Owner is fully aware, MLS information of his/ her property will appear under Placer Realty owned by the same broker, Isaac Gabriel.
